Distance sales agreement
This store operates under Turkish law (Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation). You must read and accept this agreement before completing payment.
1. Parties
Seller: embroidery DIJITAL ([Legal company name], [Tax office / tax ID], [MERSİS No]). Current address, email and phone are listed on the Contact page.
Buyer: the person who enters billing/delivery details at checkout and confirms this agreement electronically before payment.
2. Subject and scope
This agreement governs the sale and delivery of digital embroidery files and, where requested, custom digitizing services purchased through the Seller's website, under Turkish Law No. 6502 and the Distance Contracts Regulation.
The products covered are not physical goods; they are non-tangible digital content delivered electronically, typically instantly or within a short production window.
3. Product and payment
Product type, quantity, price (tax included) and payment method are shown on the order confirmation screen and receipt, and form part of this agreement.
Payment is collected upfront at checkout via the payment methods offered on the site.
4. Delivery
Catalog files become downloadable from your account immediately after payment is confirmed; there is no physical shipment.
Custom digitizing orders are delivered to your account once production is complete, within the timeframe stated on the quote.
5. Right of withdrawal
Under Article 15 of Law No. 6502 and Article 15(ğ) of the Distance Contracts Regulation, contracts for services performed instantly in electronic form, or for non-tangible goods delivered to the consumer instantly, are exempt from the right of withdrawal.
By confirming your order and completing payment, you acknowledge that the file will be delivered instantly or within the stated production window, and you expressly accept in advance that no right of withdrawal applies.
This does not affect your statutory rights regarding defective or non-conforming delivery, which are handled separately from withdrawal.
6. General provisions and force majeure
If performance becomes impossible, the Seller will notify the Buyer within a reasonable time and refund any amount paid.
Neither party is liable for failure or delay caused by force majeure (natural disaster, pandemic, cyberattack, infrastructure or provider outage, etc.); obligations are suspended for the duration.
The Buyer confirms that information provided at checkout is accurate, and is responsible for the copyright status of any artwork uploaded.
7. Dispute resolution
Disputes arising from this agreement may be brought before the Consumer Arbitration Committee or Consumer Court having jurisdiction over the Buyer's residence or the place of transaction, in accordance with Turkish consumer protection law.
Complaints can be sent through the channels listed on the Contact page and are answered within the statutory time limits.
8. Effective date
By reading and electronically confirming this agreement at checkout, the Buyer accepts it; it takes effect and binds both parties at that moment.
